PRIVACY POLICY AND TERMS OF USE

This page applies to all Android apps published by cathalsan on Google Play. Some of these apps are released under the name Clowder, which is simply an informal community and not a company or registered entity. For now, this page covers the developer's own apps.

It is organised in two parts:

  • Part I: General terms, common to all apps.
  • Part II: Per-app addenda, with the specifics of each app. This section is updated whenever a new app is released.

PART I: GENERAL TERMS (COMMON TO ALL APPS)

1. DATA CONTROLLER AND SCOPE

The controller of any personal data referred to on this page, within the meaning of the General Data Protection Regulation, is the developer who publishes the apps under the name cathalsan on Google Play, resident in the United Kingdom. Given the nature and small volume of data processed, no Data Protection Officer has been appointed, nor is one required under Article 37 of the GDPR. You may contact the controller at any time using the contact details in the footer of this page.

2. OUR COMMITMENTS

These principles apply to all apps, present and future:

  1. They are free. There is no charge for use, there are no subscriptions, and there are no in-app purchases.
  2. They contain no advertising. No ads are shown, and no advertising or data-based monetisation networks are integrated.
  3. They do not track you. No analytics, tracking, automatic crash reporting, or third-party software development kits (SDKs) that collect data are used. No advertising identifiers, and no unique, persistent device identifiers, are collected.
  4. We only receive what you send. No data is collected other than on your own initiative. The only information ever transmitted to the developer is what you choose to send through the feedback, suggestion, or problem-reporting features.
  5. That data is kept for the shortest time possible. The feedback you send is retained only until it has been processed, and is then deleted as soon as possible.
  6. There is no selling or sharing of data with third parties for commercial, marketing, or profiling purposes. Under no circumstances.

3. LEGAL FRAMEWORK

Although the amount of data processed is minimal, any processing that does occur is governed by the applicable data protection legislation, namely:

  • Regulation (EU) 2016/679 (the General Data Protection Regulation, "GDPR"), applicable to users in the European Economic Area;
  • For users in Portugal, Law no. 58/2019 of 8 August, which gives effect to the GDPR in Portuguese law, and Law no. 41/2004 on privacy in electronic communications;
  • The UK GDPR and the Data Protection Act 2018, as well as the Privacy and Electronic Communications Regulations 2003 (PECR), applicable in the United Kingdom;
  • The Google Play Developer Programme Policies, including the User Data policy, to which the apps are subject because they are distributed on Google Play.

Users in other jurisdictions are covered, where applicable, by their respective local data protection and consumer laws.

4. LOCAL-FIRST PRINCIPLE

The apps are designed to work on your device. Anything you create and enter (profiles, notes, photographs, preferences, records) is stored only on your device, in the app's local storage. There are no user accounts, no registration is required, and your content is not sent to the developer.

The only situations in which any data leaves your device are described, for each app, in Part II, and amount to: feedback that you send; requests to weather services (coordinates only, with no identifiers); and optional backup features that you enable and that use your own third-party account.

5. DATA CATEGORIES, PURPOSES, AND LAWFUL BASES

Under Article 6 of the GDPR, any processing that may occur rests on the following bases:

  • Data you enter that stays on the device (for example, profiles, notes, photographs, preferences): this is neither accessed nor received by the developer, so there is no processing by the developer; control is entirely yours.
  • Feedback, suggestions, and reports you send: processed on the basis of your consent (Article 6(1)(a)) and the developer's legitimate interest in fixing errors and improving the apps (Article 6(1)(f)). You may withdraw your consent at any time, without affecting the lawfulness of prior processing.
  • Approximate coordinates sent to weather services: processed on the basis of your consent when you enable location-dependent features, and limited to what is strictly necessary to display the forecast (data minimisation, Article 5(1)(c)).

No special categories of data within the meaning of Article 9 of the GDPR are processed. Where an app lets you enter information of a personal nature (for example, birth details in an astrology app), that information is used solely for the app to function on your device and is not transmitted.

6. FEEDBACK, SUGGESTIONS, AND REPORTS

Some apps include a feature to report a problem or send a suggestion. This feature:

  • Is always initiated by you: nothing is sent unless you tap "send".
  • Sends your message together with a minimal set of technical details useful for diagnosis: feedback type (problem/suggestion/general), app version, Android version, device make and model, and selected language.
  • Does not include your name, account, location, or any personal content you have created in the app.
  • Is transmitted over an encrypted connection (HTTPS) to a server under the developer's control, used solely to receive this feedback.

This data is used only to fix errors and improve the apps, and is deleted once dealt with.

7. DEVICE PERMISSIONS

Only the permissions necessary for the features you choose to use are requested (for example, notifications, camera, approximate or precise location, or access to vehicle data through Android Auto). Each permission is explained in the relevant app's addendum. You may decline or revoke any permission in the Android settings; some features may stop working, but the app remains usable. Permission handling follows the principle of data minimisation and the Google Play Permissions and APIs policy.

8. THIRD-PARTY SERVICES AND PROCESSORS

No third-party services for analytics or advertising are integrated. Where a feature you choose to use requires an external service (for example, weather forecasting, or backup to your own storage account), this is stated in the app's addendum. Those services process the data they receive as independent controllers or as processors, under their own privacy policies, over which the developer has no control.

9. INTERNATIONAL DATA TRANSFERS

As a rule, your data does not leave your device. In the limited situations where there is communication with external services (weather, or a backup you enable), those services may process data on servers located outside your country, including outside the European Economic Area. Such transfers, where they occur, are governed by the safeguards provided in Chapter V of the GDPR (for example, adequacy decisions or standard contractual clauses) implemented by the respective operators.

10. DATA RETENTION AND DELETION

  • Local data: remains on your device until you delete it within the app or uninstall the app.
  • Feedback sent: retained only until it has been processed and then deleted, in line with the storage limitation principle (Article 5(1)(e) of the GDPR).
  • Backups you enable: stay in your own third-party account and are controlled by you; you may delete them at any time.

11. CHILDREN

The apps are not intended for children, and no data of minors is knowingly collected. Under Article 8 of the GDPR and the applicable guidance (including, in the United Kingdom, the Age Appropriate Design Code), if it emerges that a minor's data has been processed without the necessary consent, that data will be deleted as soon as it is detected.

12. YOUR RIGHTS

Because processing is minimal and the overwhelming majority of data never leaves your device, you keep direct control: you can view, change, or delete everything within the app itself, at any time. In respect of any data you may have sent through feedback, you have the following rights under the GDPR and the UK GDPR:

  • Access to your data (Article 15);
  • Rectification of inaccurate data (Article 16);
  • Erasure, or the "right to be forgotten" (Article 17);
  • Restriction of processing (Article 18);
  • Data portability (Article 20);
  • Objection to processing (Article 21);
  • Withdrawal of consent at any time (Article 7(3)).

To exercise these rights, use the contact details in the footer of this page. You also have the right to lodge a complaint with a supervisory authority (Article 77 of the GDPR), namely, in the United Kingdom, the Information Commissioner's Office (ICO), in Portugal, the Comissao Nacional de Proteccao de Dados (CNPD), or the competent authority in your country of residence. Residents of other jurisdictions (for example, California, USA) may have analogous rights under their respective local laws.

13. COOKIES AND TRACKING TECHNOLOGIES

The apps do not use cookies or similar tracking technologies. If you reach this page through a website, that website may use cookies strictly necessary for its operation, managed by the platform that hosts it and subject to that platform's policy.

14. AUTOMATED DECISIONS AND PROFILING

No automated individual decision-making, including profiling, that produces legal effects or significantly affects you within the meaning of Article 22 of the GDPR is carried out.

15. SECURITY

Communications with external services are made over an encrypted connection (HTTPS). No user accounts or central databases holding your content are maintained, so the exposure surface is minimal. Even so, no system is completely secure, and absolute security cannot be guaranteed.

16. LEGAL NOTICE AND LIMITATION OF LIABILITY

Please read this section carefully.

  • Provided "as is". The apps are provided "as is" and "as available", without warranties of any kind, express or implied, including, without limitation, warranties of merchantability, fitness for a particular purpose, accuracy, currency, or uninterrupted availability.
  • Informational content. The information presented is for informational, educational, or entertainment purposes. It does not constitute professional advice (medical, legal, financial, horticultural, navigational, or otherwise) and is not a substitute for it. Any decisions you make based on the information in the apps are entirely your responsibility.
  • Limitation of liability. To the maximum extent permitted by applicable law, the developer shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from the use of, or inability to use, the apps, including loss of data, loss of profits, or business interruption, even if advised of the possibility of such damages.
  • Consumer rights. Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including the mandatory rights you have as a consumer under applicable law (for example, in Portugal, the consumer protection regime, and, in the United Kingdom, the Consumer Rights Act 2015).
  • Third-party content and services. The developer is not responsible for the availability, accuracy, or policies of third-party services (for example, weather or backup services) that you choose to use through the apps.

17. INTELLECTUAL PROPERTY AND THIRD-PARTY LICENCES

The apps, their code, design, text, and other original content are the property of the developer or of the respective licensors, and are protected by applicable intellectual property law. The third-party libraries and content used are subject to their respective licences, listed within each app on the open-source licences screen, where applicable.

18. ACCEPTABLE USE

In using the apps, you undertake to do so lawfully and not to use them in ways that infringe the rights of third parties, applicable law, or the Google Play policies, nor to attempt to circumvent security measures, decompile, or use the apps for unlawful purposes.

19. COMPLIANCE WITH GOOGLE PLAY POLICIES

The apps are developed and maintained in compliance with the Google Play Developer Programme Policies, including the transparency requirements of the "Data safety" section of each app's listing, which reflects the practices described here.

20. CHANGES TO THIS PAGE

This page may be updated, for example when a new app is released or a feature is added. The "Last updated" date at the top always reflects the version in force. You are encouraged to review it periodically.

21. GOVERNING LAW AND JURISDICTION

This page is governed by the law of the United Kingdom, the developer's country of residence, without prejudice to the mandatory rights granted to you by the law of your country of residence, in particular as regards data protection and consumer protection.

PART II: PER-APP ADDENDA

Each addendum describes only what is specific to that app. Everything in Part I applies equally. This section grows as new apps are released.

FAMOUS CITATIONS (phone and Wear OS)

A quotes and sayings app, fully offline.

  • Works offline. It needs no internet connection to function.
  • Local data: category preferences, favourite quotes, notification and theme settings, and the count of consecutive days of use.
  • Permissions: notifications (quote of the day) and internet (only to send feedback).
  • Data that leaves the device: only the feedback you send (see Part I, section 6).
  • Wear OS: the watch version works on its own, with no network and no permissions of its own.

ASTRALKNOWLEDGE (coming soon)

An astrology and birth-chart app.

  • Your birth details stay on your device. The name, date, time, and place of birth, the coordinates, the time zone, and the gender you enter are used to calculate the charts and are stored locally only. They are never sent off your phone.
  • Local calculations. Astronomical positions and time zones are calculated on the device itself, with no connection to the developer's servers.
  • Place lookup: when you search for a place of birth by name, that name may be sent to your device's geocoding service (usually Google) to convert it into coordinates. Only the place name is used for this purpose.
  • Permissions: internet access (for place lookup and to send feedback).
  • Data that leaves the device: the place name you search for (for geocoding) and the feedback you send.
  • Nature of the content: astrology is presented for entertainment and personal reflection, and does not constitute scientific fact or advice of any kind.

WAKAKI BONSAI (coming soon)

A bonsai tracking and care app.

  • Local data: your trees (name, species, style, dates, notes, reference code), the photo diary, and the maintenance tasks and reminders, all stored on your device.
  • Photographs: the photo diary is stored only in the device's internal memory and is never sent to the developer. It is shared only if you share it yourself.
  • Weather: to show the local forecast, the app uses your approximate location (at area level, never precise GPS) and sends only the approximate coordinates (with no identifier) to the MET Norway service. Location is not stored or associated with your identity.
  • Google Drive backup (optional): if you enable it, you can back up and restore your data to a private, hidden folder in your own Google Drive account, accessible only to this app. The developer never accesses that data. You can turn it off and delete the backup at any time.
  • Calendar export (optional): if you use it, you can export your maintenance reminders, one way only, to your own calendar. Nothing is read from your calendar.
  • Permissions: camera (photo diary and code scanning), notifications (reminders), approximate location (weather), and, for the optional features, Google sign-in and calendar access.
  • Nature of the content: the care guides are informational; there is no guarantee of results for the health of your plants.

THOREN AUTO (coming soon)

A car dashboard, through Android Auto.

  • Vehicle data: when connected to Android Auto, the app reads vehicle data (speed, fuel, range) and now-playing media metadata (title and artist only, never the content of your notifications) solely to display them on the dashboard, in real time and locally. This data is not transmitted.
  • Weather: it uses location (from the vehicle or the phone, which may be precise) to show the outside weather, sending only the coordinates (with no identifiers) to the weather service (Open-Meteo).
  • Diagnostic logs: the app may write local technical logs on your device for debugging; these logs do not leave the device and are not sent to the developer.
  • Permissions: location (weather and speed), access to vehicle data and to the media session through Android Auto, and internet.
  • Data that leaves the device: coordinates for the weather, and the feedback you send.
  • Road safety notice: this app is intended for in-vehicle information and entertainment. Always drive with your attention on the road and comply with the highway code. Do not interact with the app while driving in a way that compromises your safety. The developer is not responsible for accidents or offences arising from use of the app.
